Now you might think that being convicted of deception, fraud, and racketeering would be a bad thing, and you would be wrong, naturally. You’ve probably heard the news that a federal judge just made that ruling against cigarette makers. But the judge rejected a government proposal to slap the industry with another multibillion-dollar anti-smoking education program. Instead, Judge Kessler ruled that tobacco companies must cease labeling their cigarettes as “low tar, light, natural,” or other “deceptive brand descriptors which implicitly or explicitly convey to the smoker and potential smoker that they are less hazardous to health than full-flavor cigarettes.” Marketing Blurb does not smoke, and we not encourage others to do so. However, we do think this is a novel opportunity for gun-slinging ad copywriters to coin new cigarette adjectives which somehow skirt this injunction against deceptive language.
