
Today on Advertising Industry NewsWire, Scott G. reported that CKE Restaurants (owners of Hardee's and Carl's Jr.) is suing Jack in the Box restaurants over a television commercial that they claim leads customers to believe their angus beef hamburgers come from a cow's anus. Since angus is a type of cattle, not a cut of beef, I think this lawsuit is not only frivolous but also hilarious. I guess CKE thinks there are enough people in the 17 states where Jack in the Box does business who will be swayed by the commercial and believe their burgers come from a cow's anus to warrant a lawsuit. ![]()
While the commercial is funny (follow this link to see the ad on YouTube), I'm not sure if it will have the sweeping negative effect that CKE cites in its court papers. In fact, it seems like the lawsuit is having the opposite effect for CKE. Instead of looking like the victim of an evil attack by their competitor, CKE is receiving a negative public relations backlash, and Jack in the Box is getting positive PR. Ironic, isn't it?
